Manuscript, seven pages, halachic responsum for Hatarat Agunah, handwritten and signed by the Maharam Chaviv - the Rishon LeZion Rabbi Moshe ben Chaviv, author of Kapot Temarim and Gett Pashut - the responsum was printed in Shut Ginat Veradim, with textual variations - Jerusalem, 1691.
This is a Halachic responsum for Hatarat Agunah, handwritten entirely by the famed Gedol Hador - the Rishon LeZion Rabbi Moshe ben Chaviv (the Maharam Chaviv). Appearing at the end of this responsum is his signature: "הצעיר משה ן' חביב". The responsum contains many erasures and corrections between the lines and passages that were added on the margins. Possibly, this is a draft of the responsum, which was eventually printed in Shut GInat Veradim (Kushtandina, 1716) by Rabbi Avraham Halevi, one of the leading rabbis of Egypt, in the section of Even HaEzer, Siman 16. Printed before the printed version of the responsum: "תשובה מהרב הגדול מוה"ר משה ן' חביב על מעשה שהיה... ". The printed version contains additions and minor variations compared to this original manuscript.
The Rishon LeZion Rabbi Moshe ben Chaviv (1654-1696) Rav of Jerusalem and Rosh Yeshiva there. Was born in Salonika and immigrated to Jerusalem in his youth. Was renowned as a sharp and knowledgeable Gaon and the author of many books including Shut, halachic innovations and innovations on the Shas, the most famed of these being Gett Pahut on Hilchot Gittin, Kapot Temarim on tractate Sukkah, Yom Teru'ah on tractate Rosh Hashanah and Shut Kol Gadol. This responsum is one of his famed ones on Hilchot Agunot. The author of Mishneh Lamelech, Rabbi Yehuda Rosanis wrote of him in the approbation he gave to the book Gett Pashut: "זה ספר תולדות אדם הגדול בענקים, משה ספרא רבה דישראל, המלמד לאדם דעת משפטים ישרים ותורות, פעולת צדיק משה איש האלקים המאור הגדול הרב המופלא ריש מתיבתא דירושלים".
[4] leaves (t pages handwritten by the Maharam Chaviv). The first leaf was bound upside down (that is, begins with the second page). Bound with 6 additional leaves (10 written pages that were not identified by us) containing copying of Shut on varied matters of Even HaEzer, 22 cm.
Good-fair condition. Small tears to the edges of the leaves, slightly affecting the text of some leaves. Wear. Dampness stains. New leather binding.
