Ohr HaYashar - responsa, Psakim and writings from 1766-1768 regarding 'The Cleves Gett' affair. Edited by Rabbi Aharon Shimon of Kopenhagen, "Scribe and trustee of the state of Köln". Complete first edition, including the table of errors. Amsterdam, [1769; the year of printing was written on the title page by calculating the odd number of the words "לאות בני מרי"].


This is the copy of the geonim of the Bamberger family - among the greatest rabbis of Germany in th 19th-20th centuies , with their handwritten signatures. On the right of the flyleaf, the handwritten signature of the gaon Rabbi Simcha Halevi Bamberger Av Beit Din of Ashpenburg "Simcha the son of the gaon Yitzchak Dov Halevi" and on the left side the signature of his son Rabbi "Shlomo Bamberger, Ashpenburg"

 

'The Cleves Gett' affair is one of the most renowned halachic controversies, which stirred up the rabbinic world in its time, following a Gett given by a (slightly?) mentally unstable man. The Gett was arranged by Rabbi Yisrael Lipshitz, the rabbi of Cleves, igniting a heated halachic debate between the rabbis of the period in several countries, regarding the giver of the Gett and the question of whether Din Shoteh pertains to him. Generations have dealt with the issue and the affair led to setting rules regarding the definition of 'Shoteh', many articles being written on the subject. Before us is a basic book of this affair and the responsa printed in it are cornerstones of the Halachic ruling on the subject.
